Welcome to Elev.com.au (referred to as "we", "us", or "our"). These Terms of Service govern your use of our online store, available at Elev.com.au (the "Site"). By using this Site or purchasing from us, you agree to be bound by the following terms and conditions.

Please read these Terms carefully before accessing or using our website.

1. Overview

We provide digital elevation model (DEM) data products with 1-metre resolution, available for download upon purchase. Our products are specifically tailored for regions within Australia.

All products sold are digital downloads and not physical goods.

2. Online Store Terms

By using our store, you represent that you are at least the age of majority in your state or territory of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including copyright laws) when using our services.

3. Products & Licensing

When you purchase a product, you are purchasing a non-exclusive, non-transferable license to use the downloaded data. You agree not to:

  • Resell, sublicense, or redistribute the downloaded files.
  • Share the download links or files with others.
  • Claim the DEM products as your own creation.

You may use the data for personal, commercial, educational, or research purposes, including incorporating it into maps, reports, or analyses. You must acknowledge original data sources as provided within your product.

All intellectual property rights remain with us or our data suppliers.

4. Accuracy of Information

While we strive to provide accurate and up-to-date digital data, DEM products are provided as-is, and we make no warranties regarding their completeness, accuracy, or suitability for a particular use.

You acknowledge that all use of our digital data is at your own risk.

5. Orders & Payments

We accept payments through Shopify’s secure checkout using Shopify Payments.

All prices are listed in AUD and include GST, where applicable.

6. Delivery

All products are delivered digitally via download links after successful payment. You will receive a download link on the order confirmation page and via email.

7. Refund Policy

Due to the nature of digital products, we do not offer refunds or exchanges once the files have been downloaded or accessed, unless required by Australian Consumer Law.

If your download fails or the file is corrupted, please contact us and we’ll work with you to resolve the issue.

8. Intellectual Property

All content on this website, including logos, graphics, text, product descriptions, and downloads, is our property or that of our licensors and is protected by copyright and intellectual property laws.

9. Prohibited Uses

You are prohibited from using the Site or its content:

  • For any unlawful purpose.
  • To violate any laws or regulations.
  • To infringe upon our intellectual property rights or the rights of others.
  • To reverse-engineer, decompile, or extract data from our downloadable products beyond permitted usage.
